The Court ruled that Ms. Eweida, a Christian employee did not suffer indirect discrimination on the ground of her religion or belief when BA insisted that in line with their unifrom policy she had to conceal the cross on her necklace. The Court confirmed that it is necessary to show that the disadvantage caused is not just to the individual in question but to a group hence a claim for indirect discrimination cannot be based on the argument that one individual was disadvantaged. Furthermore, the Court stated that even if such an argument was successful the disadvantage suffered by the employee alone could be justified as a proportionate means of achieving a legitimate aim.
