Emma Czikai entered the “Britain’s Got Talent” competition last year hoping to be the next Leona Lewis or Susan Boyle… however when the judges heard her sing it was rejection all round as you can see on http://www.youtube.com/watch?v=v0XtNVGm__8 Ms Czikai has now launched a complaint under the Disability Discrimination Act 1995 against the programme’s makers for refusing to take into account her medical condition of cervical spine neuritis on the basis that it affected her ability to hear her own singing voice in noisy environments like the audition venue. She has brought her claim in an employment tribunal asserting that the Britain’s Got Talent show would amount to her employer because the show was a process of elimination where the candidates went through a series of eliminations in order to secure one of a number of employment contracts for a live tour. While it has been confirmed that the tribunal case has been lodged it will be difficult for Ms Czikai to succeed not least because the Tribunal will have to decide if it has any jurisdiction over the matter before proceeding any further into analysing the treatment of her disability. Given that the tribunal will potentially be in a position to open the floodgates to many failed reality show contestants if it does accept jurisdiction, it will be interesting to see what happens once the Britain’s Got Talent producers file their response and the tribunal is in a position to decide.
