In Whitham v Club 24 Ltd t/a Ventura (ET/1810462/10) the Empoyment Tribunal decided that an employee was unfairly dismissed for making derogatory Facebook comments. However in a previous case Preece v JD Wetherspoons plc (ET/2104806/10) (different facts), an employee was fairly dismissed for making derogatory comments about customers on Facebook whilst at work.
